А3. Individual Commercial Use License

1. Scope of Rights and Purpose

An Individual (including a Sole Proprietor until the corporate thresholds in Clause 2.3.1 of the License Terms and Conditions are met) is granted a non-exclusive, perpetual, worldwide right for the commercial use of Assets, without being limited to a single Work. The license is non-transferable and may not be sublicensed.

2. Permitted Use

  • Games, applications, plugins, and other digital products distributed under the Individual's own name (self-published, individual developer).

  • Advertising and marketing materials for the Individual's own products or services (banners, videos, landing pages, social media).

  • Visualizations (of products, architecture, interiors), presentations, publications under the Individual's name.

  • Monetized channels and platforms (YouTube, TikTok, Patreon, etc.), provided the restrictions are observed.

No Per-Title: The same Asset may be used in multiple personal projects of the Individual, subject to the restrictions.

3. Restrictions (in addition to Section 3 of the License Terms and Conditions)

The following is prohibited:

  • Transferring Assets to clients or organizations, or using them in projects commissioned by Legal Entities without a per-title license held by the Client (see Section 5 of the License Terms and Conditions).

  • Publishing or distributing source files, including Assets in catalogs, "packs," stock sites, templates; prohibition of OSS, CC — see Clause 3.11 of the License Terms and Conditions.

  • Using Assets as a trademark, logo, or element of corporate identity; registering derivatives as intellectual property items (Clause 3.2 of the License Terms and Conditions).

  • Any AI/ML use-cases — Clause 3.3 of the License Terms and Conditions.

  • NFTs, digital tokens directly or indirectly representing the Asset or providing access to it, without a separate written agreement.

  • Use for purposes that violate the law or third-party rights.

4. Technical Requirements: Anti-Extraction and Baked-In

Works must not provide functionality to export source files (FBX, OBJ, textures, etc.). "Open import/export" functionality that allows extraction of the Asset "as-is" is prohibited — see Clauses 3.7 – 3.8 of the License Terms and Conditions. Reasonable protection measures are required (packaging, obfuscation, encryption, DRM, disabling debug/export functions). The rules for Baked-In apply in full (Clause 3.13 of the License Terms and Conditions).

5. Works for Clients, Contractors, Per-Title & Title ID

If an Individual is acting as a contractor or freelancer in the interests of a Legal Entity, the obligation to license the Assets rests with the Client (per-title). In this case, the rules for Legal Entities shall apply: per-title (Appendix A4, Clause 1), Title ID is mandatory (Clauses 2.2.3–2.2.4 of the License Terms and Conditions), and transfer of Assets to the contractor is permitted only for work on the Client's Work, subject to protection and confidentiality measures. Until the Client obtains a corporate license, transfer or inclusion of Assets in deliverables is prohibited.

6. Re-download

See Clause 2.2.5 of the License Terms and Conditions: RDW of 24 months from the FDD with an active subscription; after expiry — a new Selection is required; during the 30-day Grace Period — only re-downloads (no new Selections or initial downloads). Previously downloaded Assets remain under the original license type as of the FDD; for new terms, a License Uplift or a new Selection is required.

7. Attribution

Not required, unless otherwise specified on the Asset Page. Editorial only — commercial use is prohibited; Non-Commercial only — only non-commercial use is permitted (see Appendices A2 and A1 to the License Terms and Conditions).

8. Transitions / Eligibility

Available on PRO, UNLIM, UNLIM TEAMS Plans, subject to compliance with Clause 2.3.1 of the License Terms and Conditions. If thresholds are exceeded, transition to corporate tiers is required (Clauses 2.3.2 – 2.3.5 of the License Terms and Conditions); already released projects retain their rights, new projects are subject to the terms of the current tier.

9. Warranties and Liability

Assets are provided "as is"; Section 7 of the License Terms and Conditions shall apply.

10. Miscellaneous

Compliance with Clause 3.11 (Source Files, OSS, CC) and Clause 3.12 (NSFW) of the License Terms and Conditions is mandatory.
