A4. Commercial License for Individuals (Commercial / Personal Use)

1. Purpose and Applicability

This Appendix applies to Individuals, including individual developers and sole proprietor / individual entrepreneur up to the corporate thresholds, provided that they act in their own name and not in the interests of a Legal Entity or a Client without compliance with the corporate regime.

2. Scope of Rights

An Individual is granted a non-exclusive, perpetual, worldwide right to commercially use lawfully downloaded Assets without limitation to a single Work, unless otherwise expressly provided by the License Terms and Conditions. The license is non-transferable and not subject to sublicensing.

3. Permitted Use

The following are permitted:

— games, applications, plugins and other digital products released in the name of the Individual;

— advertising and marketing materials for the Individual’s own products and services;

— visualizations, presentations, publications and monetized channels of the Individual;

— use of the same Asset in multiple own projects of the Individual, subject to the License Terms and Conditions.

4. Special Restrictions

The following are prohibited:

— use of Assets in projects commissioned by Legal Entities or Clients without applying the corporate regime;

— transfer of Assets to clients, organizations or other third parties for their independent use;

— use of Assets as a trademark, logo or element of visual identity.

5. Special Rules

Title ID is not required for Individuals unless they are acting in the interests of a Legal Entity or a Client. If an Individual begins acting in the name of, on behalf of or in the interests of a Legal Entity, Appendix A3 and the corresponding per-title / Title ID rules shall apply.

6. General Reference

In all other respects not regulated by this Appendix, the License Terms and Conditions shall apply, including, among other things, the provisions on prohibitions and restrictions of use, anti-extraction, baked-in integration, re-download, Title ID, License Uplift, liability, interpretation and priority of documents.
